SFBC Waiver & Release of Liability

I understand participating in Sperry Football Booster Club (SFBC) games and events organized or sponsored by the SFBC (collectively, “SFBC Activities”) is a potentially dangerous or hazardous activity that includes risks, including, but not limited to, the possibility of physical harm or injury, permanent disability, death and damage to property. I hereby expressly and specifically assume all risks, including, but not limited to, the risk of physical harm or injury, permanent disability, death and damage to property, associated with my participation in SFBC Activities, including, but not limited to, falls, contact with other participants, weather conditions including rain, ice, snow and cold temperatures, the conditions of the field and event locations, etc., all such risks being known and understood by me. I understand that, except as otherwise agreed to by the SFBC in writing, the SFBC does not carry or maintain health, medical or disability insurance coverage for any participants in SFC Activities.
Having read this Waiver and Release of Liability (“WRL”), knowing, understanding and willing to assume the risks associated with my participation in SFBC Activities, and in consideration of being permitted to participate in SFBC Activities, I, for my heirs, executors, administrators, legal representatives, assigns and any other person entitled to act on my behalf, as well as myself, hereby waive, release, forever discharge, hold harmless and covenant not to sue the SFBCL, its successors and assigns, its Board of Directors, officers, operators, employees, agents, other participants and any other representative of the SFBC (collectively, “Released Parties”) from any and all claims, demands, suits, judgments, damages, actions and liabilities, of every name and nature whatsoever, whenever occurring, whether known or unknown, contingent or fixed, at law or in equity, which arise or may hereafter arise from my participation in SFBC Activities. I understand and acknowledge that this WRL discharges the Released Parties from any liability or claim that I may have against the Released Parties with respect to any bodily injury, personal injury, illness, death or property damage that may result from my participation in SFBC Activities, whether or not caused by the negligence of the Released Parties. I understand that, except as otherwise agreed to by the SFBC, the SFBC does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury or illness to myself caused in any part by my participation in SFBC Activities. Except as otherwise agreed to by the SFBC in writing, I hereby release and further discharge the Released Parties from any claim whatsoever that arises or may hereafter arise on account of any first aid, treatment or service rendered in connection with my participation in SFBC Activities.
I expressly agree that that this WRL is intended to be as broad and inclusive as permitted by the laws of the state of Oklahoma, as applicable, and that this WRL shall be governed by and interpreted in accordance with the laws of the state of Oklahoma, as applicable. I agree that in the event that any clause or provision of this WRL shall be held invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this WRL which shall continue to be enforceable.

ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT
In consideration of being allowed to participate on behalf of the Sperry Football Booster Club and related events and activities, the undersigned acknowledges, appreciates, and agrees that:
1. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Sperry Football Booster Club, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)
This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releases and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releases for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.

Player/Parent Code of Conduct
1. Fighting and other conduct intended to injure others will not be tolerated and may be grounds for immediate removal from the game, field complex or program.
2. Vulgar and disrespectful language or conduct will not be tolerated and may be grounds for immediate removal from the game, field complex or program.
3. Any disagreement with an Umpire must be handled in a courteous and respectful manner by the appropriate person – be it a coach, or team manager.
4. The players and coaches from your team and all teams are to be treated with respect at all times. Good sportsmanship is to be used and encouraged at all times.
5. Each parent and coach is expected to set a good example for the players with respect to self- control and the treatment of umpires, and opposing coaches, players and parents.
6. Do not embarrass your child by yelling at players, coaches or officials. By showing a positive attitude toward the game and all of its participants, your child will benefit.
7. Parents know the rules of the game, and support the officials on and off the field. Any criticism of the officials only hurts the game.
8. All questions, complaints, grievances and comments shall be directed to the appropriate team manager, coach, or Board member at an appropriate time.
9. No parent or player will engage in any behavior or conduct that is detrimental to the individual teams; coaching staffs; or the general operations of the Sperry Football Booster Club.
FAILURE TO ABIDE BY THE “CODE OF CONDUCT FOR PLAYERS AND PARENTS” MAY BE GROUNDS FOR SUSPENSION OF PARENT AND/OR PLAYER, AND/OR REMOVAL FROM THE TEAM.

Photo & Electronic Media Release Waiver

I hereby grant permission to Sperry Football Booster Club (SFBC) and its successors, assigns, licenses, and legal representatives, the irrevocable right use my name, picture, portrait or photograph on its World Wide Web site, in electronic media (e.g., video, CD-ROM, etc.) or in other printed publications or other forms of promotion without further consideration, and I acknowledge the SFBC’s right to crop or treat the photograph at its discretion, and waive my right to inspect or approve the finished product, including written copy, which may be created in connection therewith. I hereby grant and convey unto the SFBC all right, title and interest in any and all photographic images and video or audio recordings made by the SFBC during my participation in SFBC Activities, including, but not limited to, any royalties, proceeds or other benefits derived from such photographs or recordings. I also acknowledge that the SFBC may choose not to use my photo at this time, but may do so at its own discretion at a later date.
I also understand that once my image is posted on the SFBC’s website, the image can be downloaded by any computer user. Therefore, I agree to indemnify and hold harmless from any claims the following: the SFBC, the photographer, their offices, employees, agents and designees, including league officers.
